Terms of service

Terms of Service

Overview

This website is operated by ClassReady. Throughout the website, the terms “ClassReady,” “we,” “us,” and “our” refer to ClassReady.

ClassReady provides this website, including the information, products, features, tools, and services available through it, subject to your acceptance of these Terms of Service and all other policies and notices published on the website.

By accessing our website, browsing our products, creating an account, submitting information, or purchasing a product, you agree to be bound by these Terms of Service, our Privacy Policy, Shipping & Delivery Policy, Return & Refund Policy, and any other policies referenced on the website.

These Terms apply to all website users, including visitors, customers, account holders, and individuals who submit reviews, messages, or other content.

Please read these Terms carefully before using the website. If you do not agree with them, you must not access the website or use our services.

Nothing in these Terms excludes, restricts, or modifies any consumer protection, warranty, remedy, or other legal right that cannot lawfully be excluded or limited.

Section 1 – Eligibility and Age Requirements

By using this website, you represent that:

  • You have reached the age of legal majority in your jurisdiction; or

  • You are using the website with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

Individuals who are not legally capable of entering into a binding contract may not place an order without the involvement of a parent or legal guardian.

Because ClassReady sells student school supplies, some products may be purchased for or used by children. An adult purchaser is responsible for reviewing product descriptions, age recommendations, warning labels, instructions, and suitability before allowing a child to use a product.

The website is not intended to be used independently by children to submit payment information or enter into purchases.

Section 2 – Online Store Use

You may use this website only for lawful personal, household, educational, classroom, or other legitimate purposes.

You may not use the website or any product purchased through it:

  • For an unlawful, fraudulent, or unauthorized purpose

  • In violation of applicable laws, regulations, school policies, or institutional rules

  • To harm, threaten, harass, impersonate, or deceive another person

  • To interfere with the operation or security of the website

  • To distribute malware, viruses, automated scripts, or harmful code

  • To obtain unauthorized access to accounts, systems, or data

  • To reproduce, scrape, copy, or commercially exploit website content without permission

  • To purchase products using stolen, false, or unauthorized payment information

  • To resell products in a deceptive, unauthorized, or unlawful manner

We may suspend or terminate access to the website when we reasonably believe these Terms have been violated.

Section 3 – Accounts and Customer Information

You may be permitted to create an account or place an order as a guest.

You are responsible for providing current, complete, and accurate information, including:

  • Your name

  • Billing information

  • Shipping information

  • Contact information

  • Payment information

  • Any other information reasonably required to process an order

You are responsible for keeping account credentials confidential and for activity conducted through your account, except where unauthorized activity occurred through no fault of your own.

You must promptly notify ClassReady if you believe that your account, password, or payment information has been compromised.

We may request additional information to verify an account, payment, shipping address, or order. Failure to provide reasonably requested verification information may result in an order being delayed, restricted, or cancelled.

Section 4 – Product Information

ClassReady makes reasonable efforts to present product descriptions, specifications, measurements, photographs, compatibility information, materials, quantities, and other details accurately.

However, to the extent permitted by law:

  • Colors may appear differently depending on screen settings, lighting, photography, or production variations

  • Packaging may differ from photographs displayed on the website

  • Product dimensions and weights may contain reasonable measurement variations

  • Manufacturers or suppliers may update packaging or minor product details without prior notice

  • Accessories shown for demonstration may not be included unless expressly stated

  • Product availability may change without notice

Customers are responsible for reviewing the complete product description before placing an order.

A product title, photograph, category placement, or general marketing statement should not be interpreted as including an accessory, feature, quantity, or compatibility that is not identified in the product description.

If a material product detail was displayed incorrectly, we may contact you, cancel the affected item, correct the information, or offer another appropriate resolution.

Section 5 – Product Safety and Appropriate Use

Customers must follow all manufacturer instructions, warning labels, age recommendations, maintenance instructions, and applicable school or workplace rules.

Some school supplies may contain:

  • Small parts

  • Sharp points or edges

  • Cutting components

  • Magnets

  • Adhesives

  • Inks, paints, markers, or correction materials

  • Batteries or electronic components

  • Materials requiring ventilation or adult supervision

Products such as scissors, compasses, craft knives, staplers, adhesives, art materials, laboratory accessories, or small-component products may not be suitable for all ages.

An adult purchaser is responsible for determining whether a product is appropriate for the intended student and for providing supervision when reasonably necessary.

Products must not be used contrary to their intended purpose, instructions, warning labels, or applicable laws.

ClassReady is not responsible for injury, loss, or damage caused by misuse, unauthorized alteration, improper storage, failure to follow instructions, inadequate supervision, or use inconsistent with displayed warnings, except to the extent that responsibility cannot legally be excluded.

No product should be considered suitable for every student, age group, school, classroom, or educational environment unless expressly stated.

Section 6 – Educational and Institutional Use

ClassReady is an independent online retailer.

Unless expressly stated otherwise, ClassReady is not affiliated with, sponsored by, approved by, or officially connected with any:

  • School

  • School district

  • University

  • Educational institution

  • Government agency

  • Examination organization

  • Product manufacturer

  • Brand owner

Customers are responsible for confirming that products comply with the rules, approved supply lists, technical requirements, or safety policies of their school or institution.

The availability of a product on ClassReady does not guarantee that it is permitted by a particular teacher, school, district, testing organization, or educational institution.

Section 7 – Orders and Order Acceptance

Submitting an order constitutes an offer to purchase the selected products under these Terms.

An order confirmation email acknowledges that we received your order. It does not necessarily mean that the order has been accepted, shipped, or guaranteed.

We may accept, reject, limit, or cancel an order for legitimate reasons, including:

  • Product unavailability

  • Incorrect pricing or product information

  • Payment authorization failure

  • Suspected fraud or unauthorized activity

  • Invalid or incomplete customer information

  • Shipping restrictions

  • Supplier or fulfillment limitations

  • Unusually large quantities

  • Suspected unauthorized resale

  • Violation of these Terms

  • Legal or regulatory restrictions

  • Technical errors

An order is generally considered accepted when it enters fulfillment or is shipped, subject to applicable law.

If we cancel an order after payment has been collected, we will issue an applicable refund to the original payment method.

We reserve the right to limit product quantities per customer, household, account, payment method, billing address, or shipping address where reasonably necessary.

Section 8 – Pricing and Availability

Product prices and availability may change without prior notice.

The price applicable to an order is generally the price displayed during checkout when the order is submitted, subject to correction of obvious errors and applicable law.

Prices may not include:

  • Shipping charges

  • Sales tax

  • Value-added tax

  • Customs duties

  • Import fees

  • Brokerage charges

  • Other government or carrier fees

Any applicable charges collected by ClassReady will be shown during checkout when reasonably possible.

If a product is listed at an obviously incorrect price because of a typographical, technical, supplier, or system error, we may cancel the affected order and refund any amount charged.

We do not guarantee that products will remain available until checkout or fulfillment is completed.

Section 9 – Payments

You agree to provide valid and authorized payment information.

By submitting payment information, you represent that:

  • You are authorized to use the selected payment method

  • The information provided is accurate

  • The transaction does not violate applicable law

  • Sufficient funds or credit are available

Payments may be processed by independent third-party payment providers. ClassReady does not directly control the processing systems, approval decisions, security procedures, or processing times of those providers.

An order may be delayed or cancelled when payment cannot be authorized, verified, or completed.

Your payment provider may place a temporary authorization hold. The timing for releasing a hold is controlled by the applicable financial institution and may be outside ClassReady’s direct control.

Section 10 – Fraud Prevention

ClassReady may use reasonable fraud-prevention and order-verification measures.

We may request confirmation of:

  • Billing information

  • Shipping information

  • Account ownership

  • Payment authorization

  • Identity

  • The purpose or quantity of an order

We may refuse or cancel transactions that appear fraudulent, unauthorized, abusive, or unusually high risk.

ClassReady is not responsible for delays reasonably caused by a legitimate payment or fraud review, except as otherwise required by law.

Section 11 – Taxes and Import Charges

Customers are responsible for applicable taxes, duties, customs charges, and import fees that are not collected during checkout.

For international orders, customs authorities or delivery carriers may collect additional charges before delivery.

ClassReady does not determine or control charges imposed independently by governments, customs authorities, banks, or carriers.

Failure to pay applicable import charges may result in delay, return, abandonment, or destruction of a shipment. Any refund will be handled according to our Shipping & Delivery Policy and Return & Refund Policy.

Section 12 – Shipping and Delivery

Order processing, shipping fees, delivery estimates, tracking, address changes, split shipments, delayed packages, and delivery-related responsibilities are governed by our Shipping & Delivery Policy.

Shipping and delivery dates are estimates unless expressly guaranteed in writing.

Customers are responsible for providing complete and accurate delivery information.

ClassReady may use third-party suppliers, fulfillment facilities, logistics companies, and shipping carriers to process and deliver orders.

Use of a third-party service provider does not modify any customer right that cannot legally be excluded.

Section 13 – Returns, Refunds, and Cancellations

Returns, refunds, replacements, exchanges, and cancellations are governed by our Return & Refund Policy.

A return request does not guarantee approval. Returned items may be inspected before a refund is issued.

Cancellation requests are not guaranteed after processing or fulfillment has begun.

Nothing in the Return & Refund Policy or these Terms limits any mandatory legal remedy available to a customer.

Section 14 – Promotions and Discount Codes

Promotions, coupons, and discount codes:

  • May be limited to a specified period

  • May apply only to eligible products

  • May require a minimum purchase

  • May not be combined unless expressly stated

  • May be limited to one use per customer, household, or order

  • Have no cash value

  • May be changed or discontinued where legally permitted

Discounts must be entered or applied before checkout is completed. We are not required to apply a promotional code retroactively unless required by the promotion’s published terms or applicable law.

We may cancel or restrict a promotion affected by fraud, abuse, unauthorized distribution, technical errors, or manipulation.

Section 15 – Gift Cards and Store Credit

Gift cards and store credit, when offered, are subject to the conditions displayed when issued and applicable law.

Gift cards and store credit:

  • Cannot generally be exchanged for cash except where required by law

  • Must not be resold fraudulently

  • May not be replaced if transferred to or used by an unauthorized person through no fault of ClassReady

  • May be cancelled if obtained through fraud or unauthorized payment

Customers are responsible for protecting gift card codes and account credentials.

Section 16 – Website Content and Intellectual Property

Unless otherwise indicated, the website and its content are owned by, licensed to, or lawfully used by ClassReady.

Protected content may include:

  • Store branding

  • Logos

  • Product arrangement

  • Written descriptions

  • Graphics

  • Photographs

  • Videos

  • Website design

  • Icons

  • Software

  • Downloads

  • Page layouts

You may view and use the website for personal, non-commercial shopping purposes.

You may not copy, reproduce, republish, distribute, sell, modify, scrape, frame, reverse engineer, or commercially exploit protected website content without prior written permission or another lawful basis.

Third-party trademarks, product names, and logos remain the property of their respective owners. Their appearance does not imply affiliation or endorsement unless expressly stated.

Section 17 – Customer Reviews and Submitted Content

If you submit a review, photograph, comment, suggestion, message, or other content, you represent that:

  • You created the content or have permission to submit it

  • The content is truthful and based on your genuine experience where applicable

  • The content does not infringe another person’s rights

  • The content does not contain unlawful, deceptive, defamatory, threatening, or malicious material

  • The content does not contain malware, spam, or unauthorized advertising

  • The content does not disclose another person’s private information without permission

You retain ownership of your original content.

By submitting content for publication, you grant ClassReady a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute that content for operating and promoting the store, unless prohibited by law.

We may moderate or remove content that violates these Terms, is unrelated to the product or service, contains private information, or is unlawful.

We do not require customers to waive the right to provide an honest review or penalize customers solely for expressing a truthful opinion.

Section 18 – Third-Party Tools and Services

The website may rely on or provide access to services operated by third parties, including:

  • Payment processors

  • Shipping carriers

  • Fulfillment providers

  • Analytics services

  • Hosting providers

  • Customer service tools

  • Social media services

  • Advertising platforms

Third-party services may be governed by their own terms and privacy policies.

ClassReady does not control every aspect of third-party systems and is not responsible for their independent acts, omissions, availability, or policies, except to the extent responsibility cannot legally be excluded.

Your use of a third-party service is at your discretion and may be subject to a separate agreement with that provider.

Section 19 – Third-Party Links

The website may contain links to websites that are not owned or operated by ClassReady.

A link does not necessarily mean that ClassReady:

  • Endorses the third party

  • Guarantees its products or services

  • Controls its content

  • Accepts responsibility for its privacy or security practices

Customers should review third-party terms, policies, and product information before completing a transaction through an external website.

ClassReady is not responsible for losses arising solely from an independent transaction between a customer and an unrelated third party, except as required by law.

Section 20 – Website Availability

We aim to keep the website accessible and functional, but uninterrupted availability is not guaranteed.

The website may be temporarily unavailable because of:

  • Maintenance

  • Technical failures

  • Hosting interruptions

  • Security incidents

  • Software updates

  • Network disruptions

  • Events outside our reasonable control

We may modify, suspend, or discontinue a website feature where reasonably necessary.

ClassReady is not responsible for temporary access interruptions or technical errors outside our reasonable control, except where liability cannot legally be excluded.

Section 21 – Errors and Corrections

The website may occasionally contain typographical errors, inaccuracies, or omissions relating to:

  • Product descriptions

  • Pricing

  • Promotions

  • Availability

  • Shipping charges

  • Delivery estimates

  • Product specifications

We may correct errors, update information, or cancel an affected order where permitted by law.

If a correction materially affects an order that has already been submitted, we may contact the customer and provide an appropriate option, including confirmation of the corrected terms or cancellation and refund of the affected item.

Section 22 – Privacy

Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy.

By using the website, you acknowledge that information may be processed by service providers reasonably necessary to operate the store, process payments, prevent fraud, communicate with customers, and deliver orders.

Please do not send passwords, complete payment card numbers, bank account credentials, or other highly sensitive information through ordinary email.

Section 23 – Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website, its content, and services are provided on an “as available” basis.

ClassReady does not guarantee that:

  • The website will always be uninterrupted or error-free

  • Every product will remain available

  • Every product will be suitable for every intended purpose

  • Website content will be free from all technical errors

  • Third-party services will operate without interruption

Any legally required product warranties, statutory guarantees, or non-excludable consumer rights remain unaffected.

Nothing in these Terms creates an additional warranty beyond any express warranty clearly provided in writing by ClassReady or the product manufacturer.

Section 24 – Limitation of Liability

To the fullest extent permitted by applicable law, ClassReady will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website, delayed access, loss of data, loss of opportunity, or misuse of a product.

Where liability may lawfully be limited, ClassReady’s aggregate liability relating to a product or order will not exceed the amount actually paid to ClassReady for the product or order giving rise to the claim.

These limitations do not apply to:

  • Liability that cannot legally be excluded or limited

  • Fraud or intentional misconduct

  • Any mandatory consumer remedy

  • Any other liability for which exclusion is prohibited by applicable law

ClassReady is not responsible for loss caused by a customer’s failure to follow product instructions, provide accurate information, secure account credentials, supervise a minor, or comply with applicable rules.

Section 25 – Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, or expenses arising directly from:

  • Your unlawful use of the website

  • Your material violation of these Terms

  • Your infringement of another person’s rights

  • Fraudulent or unauthorized activity conducted by you

  • Content you submit in violation of these Terms

This provision does not require a consumer to compensate ClassReady for ClassReady’s own unlawful conduct, negligence, or responsibility that cannot legally be transferred.

Section 26 – Chargebacks and Payment Disputes

If you believe a charge is incorrect, please contact us so that we can review the transaction.

Submitting a knowingly false chargeback, duplicate refund request, or fraudulent payment dispute is prohibited.

ClassReady may provide order, delivery, communication, and refund records to a payment provider when responding to a dispute.

Nothing in these Terms prevents a customer from exercising a lawful chargeback, payment dispute, or consumer protection right.

Section 27 – Suspension and Termination

We may suspend or terminate access to the website when a user:

  • Materially violates these Terms

  • Engages in fraud or unlawful activity

  • Threatens website security

  • Abuses returns, promotions, payments, or customer service

  • Infringes intellectual property rights

  • Creates an unreasonable risk to customers, ClassReady, or third parties

Termination does not eliminate obligations or liabilities that arose before termination.

Provisions concerning payments, intellectual property, liability, submitted content, and dispute resolution may continue after termination where appropriate.

Section 28 – Events Outside Reasonable Control

ClassReady is not responsible for a delay or failure caused by events outside our reasonable control, including:

  • Natural disasters

  • Severe weather

  • War or civil unrest

  • Government action

  • Labor disruption

  • Transportation shutdowns

  • Customs delays

  • Public health emergencies

  • Cyberattacks

  • Utility or network outages

  • Carrier failures

  • Supplier or fulfillment interruptions

This provision does not affect rights that cannot legally be excluded.

Section 29 – Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or separated from the remaining Terms.

The remaining provisions will continue in effect.

Section 30 – No Waiver

If ClassReady does not immediately enforce a provision of these Terms, that does not mean the provision has been waived.

A waiver is effective only when clearly confirmed in writing by an authorized representative of ClassReady.

Section 31 – Entire Agreement

These Terms, together with the policies and notices published on the website, constitute the agreement between the customer and ClassReady regarding use of the website and purchases made through it.

They replace prior or contemporaneous communications relating to the same subject matter, except for an express written agreement signed by an authorized representative.

Section 32 – Governing Requirements and Disputes

These Terms are governed by the laws applicable to ClassReady’s operation and the relevant transaction.

Nothing in these Terms deprives a consumer of mandatory protections available under the laws applicable to that consumer.

Before commencing a formal dispute, the parties are encouraged to contact each other and make a reasonable good-faith effort to resolve the issue.

Any unresolved dispute may be brought before a court or tribunal that has lawful jurisdiction over the matter.

Nothing in this section prevents either party from seeking urgent or legally available relief.

Section 33 – Changes to These Terms

ClassReady may update these Terms to reflect changes in:

  • Business operations

  • Website functionality

  • Payment or shipping services

  • Product offerings

  • Legal requirements

  • Security practices

The revised Terms will become effective when published on the website unless another effective date is stated.

Changes will not retroactively remove rights that arose under mandatory law.

Your continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
